1. RESPONSIBLE FOR THE ACCOUNT

This account is the responsibility of ARETE MACENAS RESIDENCIAL, S.L. (hereinafter referred to as ‘MACENAS MEDITERRANEAN RESORT’), with registered office at Ctra. A-334 Baza-Huércal-Overa, s/n, 04850 Cantoria, Almería and Spanish Tax Identification Number B67775882, a company registered at the Companies Registry Office of Almería, in Volume 2160, Page 28, Sheet AL-54196, Entry 1.

2. PURPOSE

The purpose of this document is to inform the Users of the official pages of MACENAS MEDITERRANEAN RESORT on Internet social media and online video platforms (hereinafter jointly referred to as ‘Social Media’) about the processing of their personal data.

3. PROTECTION OF PERSONAL DATA

3.1. What data is processed

As a general rule, MACENAS MEDITERRANEAN RESORT does not extract data from Social Media. MACENAS MEDITERRANEAN RESORT only has access to the data that the User chooses to publish on Social Media, such as their name, alias or nickname, their photo or avatar, and the rest of the data included in the User profile.

3.2. How is the data used

This data will only be used to manage the normal use of Social Media and may, depending on the situation, reply publicly or privately to Users or repost any message written by a User using the tools or functions provided for this purpose by Social Media.

3.3. Recipients of the data

As a general rule, MACENAS MEDITERRANEAN RESORT does not extract the data of the Users of Social Media or communicate them to third parties. However, the simple use of the tools or functions of Social Media (such as mentioning or reposting a message) implies the communication of their data to the rest of the Users of the corresponding Social Media.

The User should be aware of the consequences associated with the use of Social Media.

3.4. Data hosting

As a general rule, MACENAS MEDITERRANEAN RESORT does not extract the data of the Users of Social Media, and therefore this data is exclusively hosted in the information system of the corresponding Social Media.

These systems will normally be located in countries outside the European Union whose legislation does not, in the opinion of the European authorities, ensure an adequate level of protection with regard to the processing of personal data.

MACENAS MEDITERRANEAN RESORT advises the User to consult the privacy policy of the relevant Social Media in order to verify the guarantees offered in terms of data protection.

3.5. Legal basis for data processing

The legal basis for the aforementioned processing is the express consent of the User, which is given by accepting the privacy policy of the relevant Social Media and the link to MACENAS MEDITERRANEAN RESORT authorised or requested by the User.

The consent can be withdrawn at any time through the mechanisms of Social Media to cancel the link of the User to MACENAS MEDITERRANEAN RESORT.

3.6. Duration of data processing 

Due to the nature of the processing carried out by MACENAS MEDITERRANEAN RESORT, the data of the Users of Social Media will be processed for an indefinite period of time, until the User exercises their right of deletion.

3.7. User rights and how to exercise them

The data protection regulations guarantee the following rights to the Users:

• Access. This right allows the User to know what information is held, where it was obtained, to whom it has been made available and for what purposes it has been processed.
• Correction. This right allows the User to correct any inaccurate or outdated data.
• Deletion. This right allows the User to ensure that their data is no longer processed.
• Objection. This right allows the User to stop the use of their personal data for a specific purpose.
• Limitation of processing. This right allows the User to limit the processing of their data, but in such a way that the data is kept for a later purpose.
• Data transfer. This right allows the User to obtain a copy of their data in electronic form and, in certain circumstances, to request that it be transferred to another service provider. It applies only to computer processing carried out with the User’s consent or for the execution of an agreement.

The Users may request the exercise of said rights by sending a letter to MACENAS MEDITERRANEAN RESORT at the address provided, indicating their identity, the nature of their request and their status as a User of a specific Social Media site.

However, as a general rule, MACENAS MEDITERRANEAN RESORT does not extract the data of the Users of Social Media, so there will be certain rights that MACENAS MEDITERRANEAN RESORT will not be able to grant to the Users.

Should the User require further information in this respect, or should they deem that their right to data protection has been violated, they may file a complaint with the Spanish Data Protection Agency (www.aepd.es).

4. RESPONSIBILITY FOR SOCIAL MEDIA

MACENAS MEDITERRANEAN RESORT is not responsible for the actions, tools, mechanisms, functions or procedures of Social Media.

Any claim of infringement caused by a specific Social Media site should be addressed to the company that manages or is responsible for the Social Media site itself.
